User registration
User registration is possible on the artynails.shop website. Registration or user account is created for only one natural or legal person. By registering for services on artynails.shop, the user receives user account information – username and password.
The user account is not transferable to other people. The user account of legal entities can only be used by the responsible person listed as such during registration. It is expressly forbidden to provide false information during registration, and to use other people’s information for the purpose of misrepresentation on behalf of another legal or natural person.
For the violation of these provisions, Arty Nails reserves the right to shut down the user’s account, and to deny access to or execution of all or part of the services it offers, without the obligation to compensate for any cost or damage. The user is personally responsible for protecting the confidentiality of his password/password that he places during registration.

The contract is concluded by means of remote communication (A contract concluded at a distance) via: internet order – online store, or by phone with human mediation.
Method of selecting and ordering products
The products that can be purchased are advertised on artynails.shop, and with each product, product information is provided – product specification and price.
The customer selects the product based on the displayed image, identification number and/or label and product description. Product images are illustrative in nature, and do not always and in all details correspond to products that are available. Regarding the individual settings of the monitor on the computer, differences in the perception of colour by the human eye, etc. the online store on artynails.shop cannot guarantee full compliance of the product colours seen on the computer screen with the actual product colours.
Product orders are made electronically. By ordering the product, the registered user becomes the Customer. The selection of the desired product is made by clicking on the link „Basket“, after which the product is saved in the Customer’s personal virtual basket. The basket contains all the products that the Customer has chosen for purchase, together with the price of the product, the method and price of delivery and the total price for the purchase of all ordered products (s VAT included). Before completing the ordering process, the Customer must agree to the General Terms and Conditions of Purchase.
Acceptance of the product order depends on the availability of the ordered products. In case of lack of stock of the ordered product. The Seller will contact the Buyer in a timely manner and offer him a replacement product of the same or higher quality and value or remove the product from the order by agreement and reduce the final price for the purchase accordingly.
The customer can increase the number of the selected product in the basket, delete it or change it for other products. The products are considered ordered when the User (Buyer) goes through the entire ordering process and after confirming the order, he receives a confirmation that the order is placed to his e-mail address specified by(l) during the registration process received. If Arty Nails is unable to deliver some of the ordered products, it will contact the customer within 48 (forty-eight) hours and inform him by phone or e-mail that the product is out of stock and that the Customer has the option to cancel the ordered product and request a refund or request a replacement product.
Imagery:

Sale Items:
We do not accept returns on sale items, unless they are faulty. Sale items cannot be used in conjunction with any other discount, offer or code. Sale offer is valid on full price stock items only and excludes Education, Workshops, Gift Cards and Bundles and will almost always exclude the most recent collection. Further exclusions may apply.
Black Friday Event Terms & Conditions
1. Discounts Offered: During our Black Friday event, discounts will range from 10% to 50% off while stocks last.
2. No Additional Discounts: No discount codes or additional promotions may be applied during this event.
3. While Stocks Last: All discounts are subject to stock availability. We reserve the right to pause discounts on any product at any time.
4. 50% Off Items: Items featuring a 50% discount will change daily throughout the sale. Limited to one of each item per customer. Once stock is sold out, it will no longer be available.
5. Shipping Costs: Customers will be responsible for postage fees if their order does not meet the FREE delivery threshold. Please refer to our delivery details for more information.
6. Exclusions: The Black Friday event does not apply to Gift Cards, workshops, educational courses, or products that are already discounted.
7. Changes and multiple orders: Due to the high volume of orders during our Black Friday event, we cannot guarantee that changes can be made to orders once they are submitted. Additionally, we are unable to combine shipping for multiple orders.

Discounts / Offers:
Unless stated otherwise, discount codes cannot be used in conjunction with any other code, deal or discount and may not be valid on certain items such as the NEW IN category and new lines, sale goods, education, gift cards workshops, education kits, saver bundles, and the most recent collection. Please contact customer service for specific information. Discount codes may be one-time use only. FREE gifts or bundle offers are while stocks last and may be limited to one per customer and no codes can be used in conjunction. Special discounts on deliveries will be for limited periods only and may exclude some areas in the United Kingdom and Worldwide. Discounts and deals may be stopped at any time and exclusions on products may also apply.
Free Gifts:
Where we offer FREE GIFTS with purchases (minimum spend may be required) – these will be while stocks last and no discount codes or further offers can be used in conjunction. Any FREE gifts of gel polish will be restricted to the UK due to postage restrictions unless specified otherwise.
Product prices:
Product prices are retail. Product prices and delivery prices are expressed in GBP currency (£) with VAT added at checkout. Before payment, the Customer has a complete overview of the prices in the order, i.e. the amount that will be charged for the ordered products.
The seller is authorized to change prices without prior notice. The seller is also authorized to set a price lower than the regular price for a particular product, group of products and/or for all products, or for a specific payment method, without prior notice, and what (among others) includes promotional sales, sales, seasonal discounts, sales of defective products and sales of expired products. The listed benefits and price changes will be clearly indicated in the online store and available to the Customer before the actual purchase.
Arty Nails does everything to ensure that the prices listed on the website are correct, but there may be an error in the price of a product. If an error is detected in the price of a product that the Customer has already ordered, the customer will be notified as soon as possible and will be given the opportunity to confirm the order at the correct price or to cancel the order.
Payment methods:
All payments are made in GBP. The customer can pay for the ordered products via payment to the Seller’s account using a payment option on the website hosted by Stripe payments.
Termination of the Sales Agreement:
The buyer has the right to unilaterally terminate the Sales Agreement, without giving reasons, within 14 (fourteen) days from the date of delivery of the products purchased through the online store on the website artynails.shop.
In order for the Buyer to exercise the right to unilaterally terminate the Agreement, he/she must notify the Seller of its decision to unilaterally terminate the Agreement before the deadline, with an unambiguous statement in which he will state his first and last name, address, telephone and e-mail address, and he can also use the attached example of the form for unilateral termination of the contract. The user can send the statement by e-mail to sales@artynails.shop. The statement must state the account number, account date, first and last name, address, telephone and e-mail address.

After receiving the statement or form, the Seller will without delay deliver to the Buyer an confirmation of receipt of the notification of unilateral termination of the contract to his registered e-mail address.
If the Buyer unilaterally terminates the Agreement, the Seller will without delay refund the money paid by the Buyer, including money to pay shipping costs, if any, no later than within 14 (fourteen) days from the day the Seller received the Buyer’s decision to unilaterally terminate the Agreement. The refund will be made in the same way that the Customer made the payment. The Seller can refund the Buyer only after the goods have been returned to him or after proof has been provided to him that the ordered products have been sent back to the Seller.
The customer bears the direct costs of returning the goods himself, and the ordered products should be sent to the return address on the invoice without undue delay, no later than within 14 (fourteen) days from the day he sent the Seller his decision on unilateral termination of the Agreement.
The customer is responsible for any impairment of the value of the goods resulting from the handling of the Product, except for that which was necessary to determine the nature, characteristics and functionality of the Product. In order for the consumer to determine the nature, characteristics and functionality of the Product, he can treat the Product and inspect it exclusively in the way that is usual when buying physical branches. During the period in which the consumer exercises the right of return, he must keep the goods with due care.
Shipping & Delivery:
Delivery of products from the online store on artynails.shop is available for U.K. Mainland.
The seller selects the delivery person /delivery service. Delivery for the online store Arty Nails is made by the delivery service In Time , Royal Mail or some other delivery service with the delivery price specified in the customer’s shopping cart and in his completed order.
The delivery service informs each Customer about the delivery of the shipment via e-mail, and in this way the customer can correct the time when he wants delivery and call the delivery service directly. The delivery service does not have hidden billing costs if it is a matter of picking up the package by cash on delivery (eg additional commission costs etc).
Arty Nails does not assume responsibility for delivery services and deadlines for delivery of goods. Delivery times can vary from area to area, however delivery is usually within 72 hours unless it is on weekends or holidays.
If the client insists on another method of delivery, he must inform Arty Nails about this in a timely manner by phone or e-mail, in order to adapt the method of delivery to the customer’s wishes.
Shipping costs are borne by the customer.
Arty Nails grants free postage to customers with orders over £50 to U.K. mainland. If the order is sent to anywhere outside this area, delivery may take longer than 72 hours. The offer of free postage is not valid if it is products that have been reduced or are on sale, etc., or if the Customer has already received a certain discount, which means that the Customer will not exercise the right to free postage. Postage is also not free in cases where it is about packages of a larger volume, such as packages of more than 5 kg, when buying appliances, paraffin sets, etc. higher weight or when it is necessary to pay the insurance of the shipment for a higher value, etc. Free delivery is not shown in the shopping cart but is granted to the Customer after receiving the order with the calculated delivery price.
The ordered products are packed in a way that protects them from damage by normal manipulation in transport.
When picking up the product, the customer is obliged to check any damage and immediately advertise it to the delivery person who delivered the ordered products, i.e. refuse to pick up a shipment with visible external damage. When picking up the shipment, the customer is obliged to sign a delivery note or delivery note that serves as a confirmation of collection. By signing the receipt of the shipment, it is considered that the product has been taken over without external visible damage.
If the purchased product is not able to be delivered by the Seller within the specified period, he will inform the Buyer about this in order to agree on a new delivery period. In this case, the Buyer has the right to terminate the Agreement.
In cases where a product different from the one he bought was delivered to the Buyer, the Buyer has the right to request delivery of the ordered product or request a refund in the amount of the paid price of the product, delivery prices and reimbursement of product return costs and is obliged to return the wrongly delivered product.
Guarantee conditions:
Information on warranty conditions /warranty is indicated for each product and in the invoice – forwarder. If the warranty period is not specified, it means that the product is not subject to warranty.
The warranty period begins on the day the product is delivered. Arty Nails enables service and product repairs, if available and relevant, in case of failure during the warranty period.

Product complaints:
When the Buyer, during the first use of the purchased product, finds that he has received an(la) defective product or that he is not satisfied with it(a), it is necessary to contact the Seller and follow the following steps.
The Buyer should send the Seller all the necessary information about the ordered product: order number, account number or user name of the Buyer, and describe the complaint. Information should be sent electronically to sales@artynails.shop.
The Seller will without delay send the Buyer an acknowledgment of receipt of the complaint and offer him the appropriate options: can the product be exchanged for a new one, can the product be refunded, and should the product be returned.
If the complaint is justified and is not caused by the handling of the product by the Customer, and the product can be exchanged for a new one or the product can be refunded, The seller will send the delivery service to the Buyer at the postal address, which will pick up the advertised product and return it to the store.
After receiving the advertised product, the Seller will send the Buyer a notification about the refund or sending a replacement product. Refunds /submission of the replacement product will be made within 2-3 days, no later than 15 days after receipt of the advertised product. If this condition is not met, the Customer can contact Arty Nails at the e-mail address sales@artynails.shop.
If the ordered products are damaged in transport /during the delivery of the order, the damage to the shipment should be visible when picking up the shipment, so Customers are asked not to pick up such shipments and sign their receipt. In this case, the Seller will contact the Buyer in order to find an appropriate solution. If the customer has received a damaged package, he is obliged to send it in writing within 24 hours with a picture of the damage. Arty Nails takes care of its customers and their satisfaction with the products and believes that the complaint will be resolved to mutual satisfaction.
Product return:
Before concluding the Sales Agreement, the user can review the General Terms and Conditions of Purchase on the website arty-nails.org, which, among other things, are based on Article 57, para. 1. of the Consumer Protection Act (no. 41/2014), and notification of the user’s right to unilateral termination of the Agreement with the form for unilateral termination of the Agreement from Article 61, paragraph. 1 and 2. of the Consumer Protection Act.
Pursuant to article 77, paragraph 1. According to the Consumer Protection Act, the user can unilaterally terminate the Sales Agreement within 14 (fourteen) days from the receipt of the ordered products, without giving a reason.
The customer does not have the right to unilaterally terminate the Agreement if his service is fully fulfilled, and fulfilment began with his express prior consent and his confirmation that he is aware of the fact that he will lose the right to unilaterally terminate the Agreement if his service is fully fulfilled.
Pursuant to article 77, paragraph 5. According to the Consumer Protection Act, the user is responsible for any impairment of the value of the goods resulting from the handling of the goods, except for that which was necessary to determine the nature, characteristics and functionality of the goods.
The returned product must be in the original packaging and with a declaration, associated content and invoice, and other accompanying documents. Arty Nails determines the terms of the refund, i.e. the percentages of the reduction in the amount of the refund to the customer due to the reduction in the value of the product. The buyer bears the cost of returning the goods.
The Seller is responsible for material defects that the product had at the time of risk transition to the Buyer (moment of delivery of the product) and for those material defects that appeared after the risk transition to the Buyer if they the consequence of a cause that existed before that.
The seller is responsible for material defects of the product that appear within two years from the delivery of the product. For defects that appear after the expiration of two years from the delivery of the product, the Seller is responsible if he was familiar with this defect or could not remain unknown to him.
The Seller is not responsible for defects that were known to the Buyer or could not remain unknown to the Buyer at the time of concluding the Sale Agreement. It is considered that those defects that a caring person with average knowledge and experience of a person of the same profession and profession as the Customer could easily notice during the usual inspection of things could not remain unknown to the Customer. This provision does not apply to Sales Contracts that a person as a Buyer enters into outside his economic or professional activity with a natural or legal person acting as a Seller within the scope of his economic or professional activity activities (consumer contract). The buyer has the same deadline for notification to the Seller when he discovers a defect with the product that could not be detected by the usual inspection when picking up the item.
The seller is not responsible for defects that appear after two years have passed since the delivery of the purchased product.
The material defect exists:
– if the product does not have the necessary properties for its regular use or circulation,
– if the product does not have the necessary properties for the special use for which the Buyer procures it, which was known to the Seller or had to be known to him,
– if the product does not have properties and characteristics that are expressly or tacitly contracted, or prescribed,
– when the Seller has sold a product that is not equal to the sample or model, unless the sample or model has been shown for notification only,
– if the product does not have the properties that normally exist in other products of the same type and that the Buyer could reasonably expect according to the nature of the matter, especially taking into account the public statements of the Seller, manufacturers and their representatives on the properties of the product (advertisements, labelling of things, etc.); however, if the Customer, based on the statements of the manufacturer or his representative, expected the existence of certain properties of the product, the defect is not taken into account if the Seller did not know or should have known about these statements, either these statements were refuted by the time the contract was concluded or they did not affect the Buyer’s decision to conclude the contract,
– if the product is improperly mounted provided that the assembly service is involved in the fulfilment of the sales contract,
– if improper assembly is due to defects in assembly instructions.

In accordance with the Consumer Protection Act, the Buyer has the right to unilaterally terminate the Sales Agreement, without giving reasons, within 14 (fourteen) days from the day of delivery of products purchased through the online store on the website artynails.shop.
